Telehealth laws in Indiana
Indiana's telehealth statute is IC § 25-1-9.5 ("Telehealth Services and Prescriptions"). The law does not require a mandatory in-person visit before prescribing controlled substances via telehealth. Under IC § 25-1-9.5-8(b), a prescriber may issue a controlled substance prescription to a telehealth patient if they hold a valid controlled substance registration, meet federal DEA conditions, the prescription serves a legitimate medical purpose, the communication uses an audiovisual real-time interactive system, and the prescriber complies with Indiana's INSPECT prescription monitoring program.
Audio-only telehealth is explicitly insufficient for controlled substance prescribing. Video capability is required. After a first-time telehealth prescription (where no ongoing relationship exists), the provider must notify the patient's primary care provider, subject to patient consent. This notification is not required after two consecutive telehealth encounters establishing an ongoing relationship.
SEA 3 made several COVID-era expansions permanent, including prohibiting Medicaid from restricting patient location and originating sites. SEA 251 (2022) enacted the IMLC in Indiana, codified at IC § 25-22.5-16, with IMLC going live on July 5, 2023. Out-of-state providers need a telehealth provider certification under IC § 25-1-9.5-9.
