Telehealth laws in Florida
Florida's telehealth framework predates COVID. The foundational statute, Florida Statutes § 456.47, was enacted June 25, 2019, and took effect July 1, 2019. It was already a permanent law when the pandemic hit, which meant Florida did not rely on emergency waivers the way most states did.
The bigger expansion came through SB 312, signed by Governor DeSantis on April 6, 2022, effective July 1, 2022. This law opened telehealth prescribing for Schedule III, IV, and V controlled substances without restriction. Before SB 312, telehealth controlled substance prescriptions in Florida were limited to psychiatric disorders, inpatient care, hospice, and nursing home patients. Testosterone, a Schedule III substance, became fully prescribable via telehealth after SB 312 took effect. The old Florida Board of Medicine rules on telehealth prescribing (64B8-9.014 and 64B8-9.0141) were both repealed effective October 14, 2019, when the statutory framework took over.
HB 267, signed May 11, 2023, effective July 1, 2023, added audio-only telephone calls as a valid telehealth modality. Before this, Florida required video for all telehealth. Audio-only cannot be used for Schedule II prescribing, but it works for Schedule III through V and non-controlled medications.
Florida does not require a mandatory in-person visit before telehealth prescribing. Under § 456.47, if a telehealth provider conducts a patient evaluation sufficient to diagnose and treat, no prior physical examination is needed. The exception is chronic nonmalignant pain treatment with Schedule II through IV substances, which requires a physical exam and full medical history before the first prescription under § 456.44. Standard TRT, GLP-1, and HRT prescribing are unaffected by this exception.
Florida joined the Interstate Medical Licensure Compact via SB 7016 during the 2024 legislative session, onboarding in fall 2024 as approximately the 40th member state. Out-of-state physicians can also register as telehealth providers under § 456.47 without a full Florida license, provided they hold an active, unencumbered license in their home state, have a clean five-year disciplinary record, and maintain Florida-compliant malpractice coverage. Florida also participates in the Nurse Licensure Compact, PSYPact, Counseling Compact, PT Compact, and ASLP Compact.

Testosterone (Schedule III) is fully prescribable via telehealth in Florida since SB 312 took effect July 2022. No in-person visit required. Florida § 893.03 classifies anabolic steroids as Schedule III. Compounded and FDA-approved testosterone are both available.
